By an attorney who kept mouthing "mark that" at me. I mean, seriously just mouthed it at me. Then he wanted to go back over the record w/the witness where he said mark that.

So he would have me find the place where he said mark that. Then he would tell me to read the question and answer. Then he would give a dissertation on the question and answer and then make me re-read it several times. This was his method of "coaching" or "preparing" the witness for their depo.

ARRGGGHHH!!

When counsel mouths anything at me, I always say, "I didn't hear that, counsel." First and foremost, if I'm not sure I got what they said down right, could well be that I didn't! Second of all, I am concerned that the so-called mouthing is an attempt to conceal something from other counsel present, and I want to let them know something is being said.Fortunately, I have never had to do this more than twice in any proceeding.

I hope you got an hourly rate for the time spent with the attorney reading back. And it should be top dollar.

I don't think I'd go back to work with this person again, either.
