Hi all,

Well spoken atty used a word I cannot figure out. Thought I'd try here :).

Sounds like un-sul-tation.

Use: ....the problem here is the UN/SUL/TAIGS of form over substance...
and the argument is regarding what provision would apply to removing an affirmative defense.

I've scoured the dictionary for any spelling version but came up short. The only two close ones I found were incitation or exaltation.

The only thing I can find is "insultation," which is listed as an archaic usage of the word "insult." Are the attorneys arguing about form over substance?

You said the atty is well spoken, though, so I don't know that he'd/she'd say that.

I thought of that, too, Denise. Thanks. Just doesn't seem to fit quite well enough. I'm still searching, myself, and now I'm wondering if it's supposed to be "exaltation".

Basically, the other atty says there's no specific provision for how to do what he wants, that it's a matter of interpretation. Then this atty says there is a provision that would apply but since they didn't follow that -- "the problem here is the "exaltation" (?) of form over substance."

Still not sure. Any thoughts are appreciated.

Well, in doing more research I found several articles describing the "exaltation" of form over substance where the usage seems very close, so I'm going with that. I truly appreciate the help! Thanks.
