Greetings: It might actually have been Wigmore. There was a Harvard law professor who did a lot of writing about legal procedure in the mid-20th century, and he was actually very critical of the status quo in this area.
Thank you Cathryn. I did some research on Google and his name did come up, but I was not sure. This is the second time it has come up, by two different judges, so I thought I had better inquire to see what it really means.
